General Terms and Conditions for renting Villa Scholl Muravera
Version: 18 October 2026
1. Scope and contracting party
These terms apply to contracts for the temporary provision of Villa Scholl Muravera for holiday and recreational purposes and directly related services. The landlord and contracting party is the provider identified in the website imprint. Individually negotiated agreements take precedence.
2. Property and services
The agreed property and services are determined by the description shown at booking, selected dates, number of guests, price summary and booking confirmation. Images provide a realistic impression but may differ due to seasonal changes, maintenance or replacement with equivalent items. Additional services are included only if expressly stated.
3. Booking and contract formation
The website presentation is not a binding offer. The guest selects dates and occupancy, enters contact details, reviews the total price and accepts these terms. By clicking “Book with obligation to pay”, the guest submits a binding offer. The contract is concluded when the booking is successfully completed and displayed as confirmed. The email confirmation documents the contract and payment schedule. No contract is concluded if availability or technical validation fails.
The contract may be concluded in German, English or Italian; the language selected during booking applies. The contract text and the version of these terms accepted at booking are stored. Essential contract data is supplied by email with the booking confirmation on a durable medium and, where a guest account has been set up, remains available in the guest portal.
The booking person must be at least 18 and authorised to book. A person booking for others is responsible for their obligations only where expressly and separately assumed or required by law.
4. Price and payment
The total price displayed immediately before booking applies and includes the listed accommodation, cleaning and service charges plus tourist tax of € 2 per booked guest and night. The tourist tax is calculated from the entered number of guests and nights and is shown separately before the booking becomes binding. Additional charges are payable only if shown before booking or individually agreed later.
Payment follows the schedule in the price summary and confirmation. Unless stated otherwise, any deposit is due within three calendar days and the balance five calendar days before arrival. Short-notice bookings may be payable immediately. The stated payment reference must be used for bank transfers. The guest bears their own bank fees.
After an unsuccessful reasonable additional payment deadline, the landlord may withdraw and claim recoverable loss under clause 7. Mandatory guest rights remain unaffected.
5. Security deposit
A security deposit is payable only if expressly shown before booking. It secures due claims and is returned within a reasonable period after departure and inspection, less any explained claim. It does not limit the guest’s liability.
6. No statutory right of withdrawal
German law does not provide a statutory withdrawal right for non-residential accommodation booked for a specific date or period (section 312g(2)(9) BGB). The booking is therefore binding once concluded. The contractual cancellation right below remains available.
7. Guest cancellation
The guest may cancel before arrival in text form, including by email or through the guest portal. Receipt by the landlord is decisive.
The following shares of the agreed accommodation price including additional-person surcharges may be retained: 90 days or less: 25 %; 60 days or less: 50 %; 30 days or less: 90 %; 14 days or less: 100 %. Earlier cancellations are free of this charge. Tourist tax, security deposit, cleaning and service charges are excluded.
The guest may prove that no loss or a substantially lower loss occurred. Saved expenses and replacement rental income are credited.
8. Changes and replacement guest
There is no entitlement to a change of dates. The landlord may agree to changes and will disclose resulting price differences first. A suitable replacement guest may be proposed in time and refused only for objective reasons. The original guest remains responsible until an effective transfer.
9. Arrival, departure and keys
The times in the confirmation and guest portal apply. Unless agreed otherwise, check-in is from 17:00 and check-out by 10:00. Different times require consent. Keys and access devices must be kept safe and loss reported immediately. Necessary replacement or security costs may be charged where the guest is at fault.
10. Occupancy and use
Only registered guests may use the property, up to the confirmed occupancy. Subletting, transfer, events, commercial use and photo or film production require prior consent; parties are not permitted. Guests must treat the property with care, observe quiet hours from 23:00 to 07:00 and respect neighbours. Smoking is permitted outdoors only in designated areas. Pets require prior confirmation and may incur the individually agreed surcharge.
11. Guest cooperation and official registration
Guests provide complete and correct booking and registration data. Where Italian law requires identity details, all guests must provide valid documents in time. Data is used and transmitted only as legally required. Contact details must remain current and confirmations checked promptly.
12. Defects
Defects must be reported promptly through the stated contact channels and the landlord given an opportunity to remedy them. Claims may be lost to the extent a culpably omitted notice prevented a remedy. Statutory rights otherwise remain unaffected. Self-help expenses are reimbursed only after an opportunity to remedy or where immediate action was necessary to prevent substantial damage.
13. Damage caused by guests
Guests are liable under statutory rules for culpable damage caused by them, fellow travellers or persons they admit. Existing damage on arrival and new damage must be reported promptly. Normal wear is not damage. Verifiable repair, replacement and necessary consequential costs may be claimed; the guest may prove absence of fault or lower costs.
14. Landlord liability
Liability is unlimited for intent, gross negligence, injury to life, body or health, mandatory product liability and express guarantees. For slight negligence affecting an essential contractual duty, liability is limited to foreseeable, typical loss. Liability for other slight negligence is excluded. Mandatory consumer rights remain unaffected.
15. Unavailability and extraordinary circumstances
If the property cannot be provided before arrival for reasons beyond the landlord’s control, the guest is informed promptly and payments refunded. An equivalent alternative may be offered but need not be accepted. Further rights follow statutory law. Personal travel impediments remain the guest’s risk unless mandatory law provides otherwise.
16. Internet, outdoor areas and utilities
Internet is an ancillary service and uninterrupted availability or a specific speed is not guaranteed. Use must be lawful. Natural, weather-related or utility disruptions may occur in Sardinia despite proper maintenance; statutory rights apply where agreed use is materially impaired.
17. Communication and privacy
Contract communications may be sent to the booking email address and protected guest portal. The guest keeps the address accessible. The privacy policy explains personal-data processing; acceptance of these terms does not replace any data-protection consent.
18. Dispute resolution, law and final provisions
We are neither willing nor obliged to participate in dispute-resolution proceedings before a consumer arbitration board. Where a choice of law is permitted, German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory Italian rules, particularly on accommodation, guest registration, safety and public levies, and mandatory protection in the guest’s country of habitual residence remain unaffected. Statutory jurisdiction rules apply; no exclusive venue is imposed on consumers.
If a provision is invalid, the remainder of the contract remains effective and statutory law applies instead. Changes do not apply retrospectively; the version accepted at booking governs.
